The petitioner has preferred this application for grant of regular bail in a case registered under sections 354B 147, 148, 149, 341, 323, 379, 448, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the eight named accused persons including the petitioner herein with ill intention started to pull the informant and on her raising hulla, partly disrobed her. Co-accused Manish Kumar is said to have fired creating terror and the petitioner took away the mobile phone worth Rs. 8,000/-.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No

Patna High Court CR. MISC. No.70803 of 2021(2) dt.06-06-2022 2/2 such occurrence as alleged has taken place nor any person was injured in the occurrence. The petitioner is in custody since 13.10.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner having remained in custody for more than 7 months and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Maheshkhunt P.S. Case no. 144 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria.
