The petitioner seeks regular bail in connection with Dehri (Town) P.S. Case No. 102 of 2017, dated 15.02.2017, registered under Sections 30(A) 38 (i) and 41 (i) (ii) of Bihar Prohibition of Excise Act, 2016.

The case of the prosecution is that while the police personnel were on patrolling duty, they got secret information that sale of illegal liquor was going on whereafter the police party reached at the place of occurrence and found a person holding a plastic bag, who upon seeing the police party, started fleeing away and from the aforesaid bag, 150 pouch containing 200 ml. each of illicit liquor was recovered.

Patna High Court Cr.Misc. No.26545 of 2017 (2) dt.13-06-2017 2/2 Learned counsel for the petitioner submits that the petitioner has not been apprehended from the place of occurrence. It is further submitted that the petitioner is in custody since 27.04.2017 and has clean antecedent.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeII-cum-Special Court Excise, Rohtas at Sasaram in connection with Dehri (Town) P.S. Case No. 102 of 2017.

The learned counsel for the petitioner seeks permission to make correction in the petition by adding the alias name of the petitioner. Let the same be done during the course of the day. (Mohit Kumar Shah, J) khushbu/- U T
