10-04-2015 Heard learned counsel for the petitioner and Sri B.M.P. Sinha, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Bhagwanpur P.S. Case No.109 of 2011 registered for the offence under Sections 406 and 420 of the Indian Penal Code, has prayed for grant of anticipatory bail.

The petitioner is a P.D.S. dealer. It was submitted by learned counsel for the petitioner that in a writ petition, this Court had directed the petitioner to file a representation before the Block Development Officer, Bhagwanpur raising his grievance. However, despite the fact that the petitioner filed representation, no decision has been taken by the Block Development Officer. The Court is of the opinion that the present matter

Patna High Court Cr.Misc. No.46082 of 2014 (2) dt.10-04-2015 2/2 relates to F.I.R. of Bhagwanpur P.S. Case No.109 of 2011, which has got no connection with decision on the representation of the petitioner.

Keeping in view the fact that F.I.R. was lodged in the year 2011, I do not think it proper to extend the privilege of bail to the petitioner. The petition stands dismissed. (Rakesh Kumar, J) NKS/- U
