2. The petitioner apprehends his arrest in connection with Lalganj P.S. Case No. 171 of 2025, registered for the offences punishable under Sections 140(3), 87, 3(5) of the BNS

3. The informant reveals allegation on co-accused Vishwajeet Kumar that he has kidnapped her daughter with intent to marry her. It is further alleged that the petitioner , his brother and father have also complicity.

4. The learned counsel for the petitioner has submitted that the petitioner is the brother of the main accused Vishwajeet Kumar against whom there is allegation of kidnapping and merely because he is the brother of the main accused, he has been arrayed in this case as an accused with his other family members. The petitioner is a person of clean antecedent.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. The investigating officer and SHO, in complaince of earlier order of this Court, are present in the Court. They submits that they are taking their best efforts to procure the appearance of Vishwajeet Kumar and the victim girl but still they are traceless.

7. Except the allegation that petitioner is the family member of the main accused, there is nothing against him and he is a person of clean antecedent.

8. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 171 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C/ 482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) priyanka/- U T
