JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Masurhi P.S. Case No. 515 of 2019 registered for the offences punishable under Sections 341, 323, 325, 307, 504, 506 and 34 of the Indian Penal Code.

Allegation as per FIR is that petitioners assaulted the informant by means of rod on his hands and legs. It further appears that occurrence took place with respect to raising of boundary wall.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and land dispute is admitted in the FIR and allegation itself shows that assault is not on the vital part of the body.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri B. N. Tripathi, Judicial Magistrate, 1st Class, Masaurhi, Patna, in connection with Masaurhi P.S. Case No. 515 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
