2. Earlier prayer for bail of the petitioner was rejected twice by this Court vide order dated 21.02.2022 and 14.09.2022 in Cr. Misc. No. 41564 of 2021 and Cr. Misc. No. 36696 of 2022.

3 . It is submitted on behalf of the petitioner that out of seven prosecution witnesses, five witnesses, including the victim as well as mother of the victim, have been examined. They have not supported the prosecution case . Victim has not identified the petitioner and and the petitioner is in custody since March 12, 2021.

4. Considering the period of custody and also the

No.64016 of 2023(3) dt.10-11-2023 2/2 deposition of the victim, petitioner, above named, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and sessions Judge - VII-cum-Exclusive Special Court (POSCO Act), Patna in connection with Special Case No. 36 of 2021 arising out By Pass Police Station Case No. 89 of 2021 .
