Petitioner seeks bail in connection with Saraiya P.S. Case No. 119 of 2017 registered for the offence punishable under Sections 379, 411, 413 and 414/34 of the Indian Penal Code. The prosecution case, as lodged by the police personnel, is that on the road the public caught hold one person (petitioner) along with one motorcycle and handed him over to the police. Police demanded the paper of the said motorcycle, but he did not produce the same. The apprehended accused stated that the motorcycle belongs to his brother-in-law, who had purchased it from other coaccused, Guddu Ram and Niranjan Kumar. Accordingly, a

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and he was driving the motorcycle of his brother-in-law and he is neither the seller nor the purchaser of the said vehicle and has been falsely implicated only on the basis of suspicion.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Saraiya P.S. Case No. 119 of 2017.
