2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 365/34 of the Indian Penal Code.
3. The allegation against the petitioner along with others is of kidnapping one Suryabhushan with an intention to grab ransom.
4. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.62304 of 2023(2) dt.21-09-2023 2/3 that petitioner has been falsely implicated in this case due to dirty village politics. He has committed no offence. He submitted that there was dues of the petitioner and other accused persons upon the alleged victim and mainly on that reason, the petitioner has called the alleged victim so that the alleged victim can return the money and to say that when he will return the money, but merely on suspicion the informant has lodged this false and concocted case against the petitioner. The victim has been recovered from the orchard along with other co-accused persons without any type of arms but petitioner was not there, even one of the accused has disclosed the name of the petitioner. During investigation, not even a single independent witnesses have supported the prosecution case. He further submitted that the ransom money has not been executed. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 13.07.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged
Patna High Court CR. MISC. No.62304 of 2023(2) dt.21-09-2023 3/3 on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Court below in connection with Laherimuhalla P.S. Case No. 511 of 2022.
