The petitioner apprehends his arrest in connection with Biraul P.S. Case No. 231 of 2018, registered under Sections 147, 148, 149, 447, 341, 323, 324, 379, 307 and 504 of the Indian Penal Code, pending in the court of the Addl. Chief Judicial Magistrate, Darbhanga.

The accusation is that on 21.09.2018, informant Ram Sogarath Yadav was engaged in constructing the septic tank (latrine) in his land, at that time, six persons named in the F.I.R. including the petitioner variously armed with weapons came there and started to abuse the informant and forbade to construct the said work. When informant made protest, then on the order of Jainath Yadav, this petitioner gave Farsa blow at

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
