JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-09-2018 In view of the law laid down by this Court in 2001 (4) PLJR 713 (Md. Zakir Hussain vs. Hareshwar Prasad Singh & Ors.), the order of Munsif, who is hearing election matters of Panchayat election, shall not be treated as passed by the civil court. Mr. Ansul, the learned counsel for the petitioner seeks permission to withdraw this civil miscellaneous petition with liberty to file writ petition under Article 226 of the Constitution of India and correct the subject matter accordingly.
Prayer is allowed and this civil miscellaneous petition is dismissed as withdrawn with the aforesaid liberty. Let the certified copy of the impugned order be returned to the learned counsel for the petitioner after keeping a photo copy of the same with the record.
