2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 149, 188, 341, 323, 324, 307, 353, 332, 333, 506 and 34 of the Indian Penal Code and Sections 3 and 4 of the Public Property Damage Act.

The prosecution story, in brief, is that on the alleged date and time of occurrence, all the F.I.R. named accused persons, including this petitioner and 40 to 50 unknown persons, assaulted and pelted stones on the police party and damaged the police vehicles as a result of which, several police personnel sustained injuries.

4. It is submitted by learned counsel appearing on

Patna High Court CR. MISC. No.59368 of 2025(2) dt.02-09-2025 2/2 behalf of the petitioner that petitioner is quite innocent and has committed no offence. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. Petitioner has falsely been implicated in this case merely on suspicion. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, assaulted the police party, pelted stones on them and damaged the police vehicles as a result of which, several police personnel sustained injuries and thus, created hindrance in discharge of their official duties.

6. Considering the facts and circumstances of the case and nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected.
