In this case, the petitioner is seeking regular bail in connection with Atri P.S. Case No. 70 of 1994, registered for the offenses punishable under Sections 147, 148, 149, 323, 324, 307, 325 of the Indian Penal Code, under Section 27 of Arms Act and Under Section 17 of C.L.A. Act.

the learned counsel for the petitioner has submitted that the bail bond of petitioner was canceled on 08.01.2020 and he surrendered on 18.04.2022 since then he is under custody. Considering the above-mentioned facts and circumstances as well as period of custody, let the petitioner, above-named, be released on bail on furnishing bail bonds of

No.63657 of 2022(2) dt.01-05-2023 2/2 Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Gaya in connection with Atri P.S. Case No. 70 of 1994, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available on each and every date of trial. In case of failure on two consecutive dates without any valid reason, the learned court below will be at liberty to cancel the bail bond of the petitioner. (ii) If the petitioner is found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
