This is an application for bail in connection with Rail (M.F.P.) P.S.Case No. 30 of 2017 registered for the offences punishable under Sections 401, 414 of the Indian Penal Code and 8 and 22 of NDPS Act.
Allegation against the petitioner is of recovery of nine intoxicant tablets, Voter I.D., Blade, Mobile phone, etc. from the possession of the petitioner.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and there is no material available on record to show that the recovered tablets are intoxicant and he is in custody for four months. Heard learned APP also.
Patna High Court Cr.Misc. No.27350 of 2017 (2) dt.12-07-2017 2/2 Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner.
However, learned trial court is directed to expedite the trial and try to conclude the same within six months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.
Accordingly, this application is dismissed.
