JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Excise Case No. 333 (C2)/2021 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The Excise Official, on the basis of secret information, that one Piaggio vehicle loaded with illicit foreign liquor is coming from Jharkhand to Jamui, proceeded towards the place of occurrence and recovered a total quantity of 131.25 litres of illicit foreign liquor from the same and driver along with other accused persons were arrested.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.71089 of 2021(2) dt.26-05-2022 2/2 petitioner claims to be the passenger of the said vehicle and he has no concern with the alleged recovery of illicit liquor. He is in custody since 21.09.2021 and has got no criminal antecedent. Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that petitioner was the passenger of the vehicle from which the illicit liquor was recovered and he is in custody since 21.09.2021 having clean antecedent, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Jaui, Distt. Jamui (Bihar) in connection with Excise P.S. Case No. 333 (C2) /2021.
