2. The petitioner is in custody since 18.07.2023 in connection with Kotwa P.S. Case No. 343 of 2022 registered for the offence punishable under Sections 395 of the Indian Penal Code.

3. The petitioner and others are said to have looted a truck, cash of Rs. 30, 000/- and two mobile phones. The petitioner is in custody since 18.07.2023. The looted truck has been recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to dirty politics. Learned counsel for the petitioner submits that nothing incriminating has been recovered from the possession of the

Patna High Court CR. MISC. No.64463 of 2023(2) dt.11-10-2023 2/2 petitioner. He further submits that similarly situated co-accused has already been granted bail by a co-ordinate Bench of this Court vide order dated 31.08.2023 passed in 36892 of 2023.

5. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Kotwa P.S. Case No. 343 of 2022.

6. The petitioner will deposit a demand draft for an amount of Rupees Twenty-five Thousand prepared in the name of the informant and the same shall be handed over the informant at the time of accepting bail bond. (Sandeep Kumar, J) Saif/- U T
