JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Laxmipur P.S. Case No. 180 of 2012 registered for the offence punishable under sections 302, 120B/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been implicated in this case merely on suspicion. There is no eye witness to the alleged occurrence. None of the witnesses has said anything suggesting complicity of this petitioner in the alleged crime.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named in the first information report. During investigation, the case has been found true against this petitioner. Viscera report shows that Endo Sulfas was detected.
Patna High Court Cr.Misc. No.31070 of 2017(4) dt.18-09-2017 2/2 Considering the nature of allegations levelled and the submissions advanced on behalf of the parties, this court does not find it to be a fit case for grant of anticipatory bail. It is, accordingly, rejected.
