JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 30(c)/56 of the Bihar Prohibition and Excise Act, 2016.
From the house of this petitioner foreign and country-made liquor was allegedly recovered. Wife of the petitioner was allegedly apprehended at the spot thereafter she was allowed bail by the learned Chief Judicial Magistrate as submitted by learned counsel for the petitioner.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.29502 of 2017 (2) dt.05-07-2017 2/2 amount each to the satisfaction of learned Additional Sessions Judge-IV, Bhojpur at Ara/Successor Court, in connection with Excise Case No.110 of 2017, arising out of Ara Town P.S. Case No.24 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
