The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 504, 295A/34 of the Indian Penal Code, 3(1)(x) of SC/ST (Prevention of Atrocities) Act and 3/4 of Prevention of Witch Practices Act.
It is alleged that the informant took a room on rent of Rs.1700/- per month and also given rupees fifty one thousand as security money, but subsequently the petitioners and others assaulted the informant and abused by calling caste name.
Patna High Court Cr.Misc. No.53313 of 2015 (2) dt.23-11-2015 2/2 It is submitted by learned counsel for the petitioners that for a civil nature of dispute the accusation has been levelled. Subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-4, Araria in connection with Fulkaha P.S. Case No. 34 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
