The petitioner seeks bail in connection with Kurtha P.S. Case No.178 of 2016 registered under Sections 25(1-b)a and 26 of the Arms Act.

The accusation is that on 04.11.2016 in the evening at about 05.00 P.M., the informant being the Sub Inspector of Police StationKurtha (Manikpur O.P.) reached in the village-Barhaiya for investigation in connection with Kurtha (Manikpur) P.S. Case No.177 of 2016 lodged by Nilu Kumari, the wife of the petitioner. Thereafter, one person, who was sitting in the house, on seeing the police, started to flee away but, on chase, he was apprehended, who, on query, disclosed his name as Sunil Kumar (petitioner), the accused of Kurtha

Patna High Court Cr.Misc. No.16505 of 2017 (3) dt.30-06-2017 2/2 (Manikpur) P.S. Case No.177 of 2016. On search, the petitioner was found in possession of one loaded country made pistol. Learned Senior Counsel appearing on behalf of the petitioner submits that the petitioner used to reside at Haryana and when he came to his house, he came to know about illicit relation of his wife Nilu Kumari with someone and when he tried to convince his wife Nilu Kumari, Nilu Kumari lodged Kurtha (Manikpur) P.S. Case No.177 of 2016 on 04.11.2016 under Sections 342, 323, 504, 506 and 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, after 23 years of her marriage against the petitioner and she also managed to implicate the petitioner in this false case. The petitioner is in custody since 04.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal, in connection with Kurtha P.S. Case No.178 of 2016.
