The petitioner seeks bail in connection with Bhabua P.S. Case No. 113 of 2017, registered under Section 304(B) and 201/34 of the Indian Penal Code.

The allegation of informant is that she performed marriage of her daughter Pummi Kumari with Mantu Giri, son of Shiv Chandra Giri, Resident of Patel Chowk, P.S. Bhabhua, District-Kaimur before two years. In the night of 27-28.02.2017, she received information about serious illness of her daughter, thereafter, she become nervous thinking about miss-happening. In the meantime, she received information that her daughter has died. When informant reached at the house of his daughter then

Patna High Court Cr.Misc. No.24363 of 2017 (3) dt.30-06-2017 2/2 she came to know that dead body of her daughter was burnt. It is alleged that earlier her daughter was being tortured due to nonfulfillment of demand of dowry. Learned counsel for the petitioner submits that, in fact, petitioner is mother-in-law of the deceased and deceased was suffering from illness prior to her marriage and she was under treatment and she died due to illness and regarding which the information was also given to the informant, but with ulterior motive the petitioner and other family members have been implicated in this case. Further submission is that petitioner is in custody since 01.03.2017 and husband of the deceased is in custody.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur (Bhabua) in connection with Bhabua P.S.
