JUSTICE SANJAY PRIYA ORAL ORDER 30-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Goroul P.S. Case No. 275 of 2004 instituted for the offence under Sections 323, 406, 498(A) and 304(B) of the Indian Penal Code.

The petitioner is husband of the deceased. There is specific allegation against the petitioner that he committed physical and mental torture with the sister of the informant for demand of dowry and on non fulfillment of the aforesaid demand, he assaulted his sister (informant) on account of which she died.

In such circumstances, this Court is not inclined to grant bail to the petitioner at this stage.

Prayer for bail of the petitioner stands rejected.

Patna High Court Cr.Misc. No.19869 of 2017 (3) dt.30-06-2017 2/2 The court below is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months.

The petitioner is given liberty to renew his prayer for bail in the court below itself in the event the trial is not concluded within nine months and the court below in that case will give reason in the bail order for not concluding the trial within aforesaid period.
