JUSTICE SHIVAJI PANDEY) 02-03-2021 Heard learned counsel for the petitioner and learned counsel for the State.

This application has been filed for modification of the order dated 23.01.2019 passed in CWJC No.1384 of 2019 by this Court by which vehicle of the petitioner bearing Registration No.BR-03GA-4533 has been provisionally released subject to certain conditions with one surety along with a Bank Guarantee to the extent of value of the vehicle as indicated in the insurance document.

Patna High Court MJC No.3429 of 2019(4) dt.02-03-2021 2/2 Counsel for the petitioner submits that he is unable to give the Bank Guarantee for release of the vehicle, but he submits that he will pledge his land, details of which has been mentioned in paragraph 6 of the supplementary affidavit filed on 26.02.2021, in place of Bank Guarantee.

Counsel for the State has objected the prayer of the petitioner.

In such view of the matter, the Bank Guarantee is substituted by pledging the land in favour of the Confiscating Authority-cum-Collector, Bhojpur at Ara.

Accordingly, the order dated 23.01.2019 stands modified to the aforesaid extent only.

This application stands disposed of.
