JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-07-2017 The petitioner seeks regular bail in connection with Baisi P.S. Case No. 33 of 2016, registered for offences punishable under Sections 363, 366A of Indian Penal Code.
Allegation against the petitioner is of kidnapping the victim girl and confining her in his house for five days. It has been submitted on behalf of the petitioner that except the fact that the victim girl was recovered from the house of the petitioner, there is no further allegation against the petitioner and further during the course of investigation, it has come that the girl was in visiting terms with the petitioner. Further petitioner has been in judicial custody since 05.04.2016. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances
Patna High Court Cr.Misc. No.19385 of 2017 (3) dt.07-07-2017 2/2 of the case and the nature of allegation, and also the statement of girl recorded under Section 164 Cr.P.C, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible.
