This application is for grant of regular bail in connection with Phulwarisharif P.S.Case no.1036 of 2018for the offences under Section 302 of the Indian Penal Code. Earlier the prayer for bail of the petitioner was rejected by the then Co-ordinate Bench of this Court, vide order dated 23.7.2019 passed in Cr. Misc. No.35764 of 2019 on merit. Petitioner is said to have killed the deceased. Submission of the learned counsel for the petitioner is that he is in custody since 24.12.2018 and up till now not a single witness has been examined.

Heard learned A.P.P. also.

Having heard both sides and in view of allegations, I am not inclined to grant bail to the petitioner at this stage,

Patna High Court CR. MISC. No.56707 of 2019(4) dt.06-02-2020 2/2 however, the learned trial court is directed to expedite the trial and conclude it as expeditiously as possible and preferably within a period of nine months.

With the aforesaid observation, this application is dismissed.
