JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is said to shot fire on the deceased, as a result of which, the deceased died then and there. Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, prayer for bail of the petitioner stands rejected.

However, it is informed that the case has already committed to the court of sessions and is presently pending in the court of learned Additional Sessions Judge-III, Khagaria vide Sessions Trial No. 391 of 2014 arising out of Beldaur P.S. Case No. 88 of 2014.

Patna High Court Cr.Misc. No.47361 of 2014 (2) dt.16-04-2015 /2 Accordingly, learned Additional Sessions Judge-III, Khagaria is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
