Petitioner is apprehending his arrest in connection with Complaint Case No.1743 of 2017 Tr. No.827 of 2019 , registered for offences punishable under Sections 498A and 323 of the Indian Penal Code.

As per the complaint petition, there is allegation of demand of dowry and for that assaulting the complainant, who happens to be wife of the petitioner.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner, his cognizance has been taken and there is no chance of tampering with the evidence. Furthermore, he is still ready to keep her with dignity and care but she is not ready to reside with the petitioner .

Patna High Court CR. MISC. No.56457 of 2019(3) dt.16-11-2019 2/2 Heard learned A.P.P. and the learned counsel for the O.P.no.2 who has appeared on notice and submitted tht she was subjected to cruelty. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Deepak Kumar , J.M. Ist Class, Muzaffarpur in connection with Complaint Case No.1743 of 2017 Tr. No.827 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
