The petitioner is in custody since 14.8.2014 in connection with Chandauti P.S. Case No.180 of 2014 registered for the offences under Sections 25(1-B)A/26 of the Arms Act. The allegation against the petitioner is that one bolt of rifle, one country-made pistol and one country-made revolver of six rounds were found in the eastern room from Angan in white coloured Jhola.

Learned counsel for the petitioner submits that the recovery was not made from the conscious possession and that the petitioner has been falsely implicated in the present case due to dirty village politics.

Considering the aforementioned submissions and the
