Though counter affidavit has been filed on behalf of the respondents no. 5 to 9 but the Court finds the same not satisfactory.

Learned counsel for the State submits that he has received full instructions including copy of the case diary. He submits that from the same it transpires that immediately after lodging of the F.I.R., the named accused had been taken

Patna High Court Cr. WJC No.1149 of 2014 (4) dt.21-07-2015 2/2 into custody and also interrogated. He submits that the police have even investigated on the call data record of the accused and accordingly chargesheet has been submitted under Sections 302/201/34 of the Indian Penal Code. In view of the aforesaid, the application stands disposed off with liberty to the petitioner to avail of the remedies available to him under the law.
