JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 02.02.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Taking into consideration that earlier prayer for anticipatory bail of these petitioners was rejected by a coordinate bench of this court vide order dated 10.03.2011 passed in Cr. Misc. no. 38308/2010 taking note of allegation and materials, I am not inclined to extend privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection with Mahua P.S. case no. 317/2008 pending in the court of the Chief Judicial Magistrate, Vaishali at Hajipur stands rejected.

However, petitioners must surrender before the

No.4296 of 2015 (2) dt.02-02-2015 court below within four weeks from today and seek regular bail and if they do so, the concerned court shall pass appropriate order on the prayer for regular bail application of the petitioners without being prejudiced by order of rejection of this court.
