Mr.Renu Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-09-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
Petitioners apprehend their arrest in connection with Muffasil P.S. Case No.272 of 2019 for the offence punishable under Sections 341, 323, 307, 448, 504, 506, 34 of the Indian Penal Code.
The allegation against the petitioners as per the First Information Report is that on the date of occurrence, the petitioners who are cousin of the informant and petitioner No.3 is ex.-husband of the informant entered into the house of the
Patna High Court CR. MISC. No.56598 of 2019(2) dt.06-09-2019 2/3 informant and assaulted her with intention to kill. Mr. Ramesh Kumar Singh, learned counsel appearing for the petitioners submits that both the parties are close relative and there appears to be dispute between them due to the fact that there is marriage dispute between petitioner No.3 and informant. Learned counsel further submits that no serious injuries have been caused to the informant due to the alleged assault. On the other hand, learned counsel appearing for the State submits that from perusal of the case dairy, it appears that injuries caused to the informant are simple in nature. After having heard learned counsel for the petitioners as well as learned counsel appearing on behalf of the State and taking into consideration the fact that both the parties are close relatives and injuries caused to the informant are simple in nature, as such, I am inclined to grant anticipatory bail to all these petitioners.
Accordingly, all the petitioners, above named, are directed to surrender before the learned Court below within a period of four weeks and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of
