JUSTICE BIRENDRA KUMAR ORAL ORDER 03-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147/148/149/341/324/307/327/452 of the Indian Penal Code and Section 27 of the Arms Act.
According to F.I.R. the petitioner fired shot causing injury at the arm of the mother of the informant. I do not find any merit in the submission of learned counsel for the petitioner that there is old land dispute between the parties and for that reason false implication is there and some other co-accused, who were member of the unlawful assembly
Patna High Court Cr.Misc. No.50648 of 2016 (4) dt.03-02-2017 2/2 have already been allowed anticipatory bail by this Court. Hence, I am not inclined to grant anticipatory bail to the petitioner in connection with Amarpur Police Station Case No. 81 of 2016, pending in the Court of learned Chief Judicial Magistrate, Banka/Successor Court.
Accordingly, the prayer for anticipatory bail is rejected. (Birendra Kumar, J) Mkr./- U T
