JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2020 Heard learned counsel Mr. Upendra Kumar Chaubey, appearing for the petitioner as well as learned Additional Public Prosecutor Ms. Rina Sinha, appearing for the State through video conferencing.

Petitioner apprehends his arrest in connection with Complaint Case No. 490[c] of 2018 in which cognizance for the offences punishable under Sections 406, 420, 504 and 120[B] of the Indian Penal Code.

Earlier, a notice was send to Opposite Party No. 2 and notice was received by the brother of Opposite Party no. 2. Subsequently, the petitioner filed an affidavit of jointness showing that the Opposite Party No. 2 as well as his brother are joint. However, no one appears on behalf of Opposite

Petitioner happens to be retailer of the complainant and no specific over act has been attributed against him. Moreover, employees of complainant (Opposite Party No. 2) have already been admitted to the anticipatory bail by Coordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submission of the petitioner, this anticipatory bail petition is allowed and it is ordered that the petitioner in the event of his arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Vth, Danapur, Patna in connection with Complaint Case No. 490[c] of 2018 subject to conditions as laid down under Section 438 (2) of the Cr.P.C.
