2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a and other allied sections of the Bihar Prohibition and Excise Act and sections 272/ 273/414/34 of the Indian Penal Code.

3. As per the prosecution case, 949 liters illicit liquor was recovered from bolero vehicle.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner nor driver of the vehicle in question. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery.

5. Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner has got criminal

Patna High Court CR. MISC. No.64334 of 2023(2) dt.16-10-2023 2/2 antecedent of similar nature, as such, he cannot be allowed privilege of pre-arrest bail.

6. Considering the fact that the petitioner has got criminal antecedent of similar nature, his prayer for bail is refused.
