JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2017 The petitioner seeks regular bail in connection with Bihpur P.S. Case No. 343 of 2017, registered for offences punishable under Sections 302, 120B/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R, his name transpired in this case during the course of investigation on the suspicion of informant that while she was lying in the verandah of temple, she heard a noise of firing and rushed at the place of occurrence and found her husband dead and suspected that as Ex-Mukhiya late Surendra Singh was in inimical terms with the family of informant, one of the persons, who is very close to Ex-Mukhiya has killed her husband and except that there is nothing against the petitioner so as to connect him with the present case. Further petitioner has

been in judicial custody since 15.12.2016.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case and submission of learned counsel for the parties, this application is disposed of with a direction to court below that if charges are framed in this case and no allegation save and except what is stated by learned counsel for the petitioner is found, he will release the petitioner on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Naugachia, District - Bhagalpur, in connection with Bihpur P.S. Case No. 311 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event

of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
