====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 395 and 397 of the IPC. The prosecution story, in brief, is that the informant Panchu Kumar alongwith one Chandan Kumar was going to Bank for making Bank Draft of Rs. 2,70,000/-. In the Bank, they were asked to come on next day because the staff is not present today who used to prepare the Bank Draft. Thereafter, the informant was returning from the Bank on his Motorcycle with Chandan Kumar. In the meantime, accused persons who were being armed with deadly weapons, surrounded the informant

Patna High Court CR. MISC. No.59241 of 2019(2) dt.19-09-2019 2/3 and on the point of arms, accused persons snatched the bag in which Rs. 2,70,000/- was kept in the dickey of the Motorcycle and the miscreants fled away from there.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 24.07.2019. The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Both parties are covillagers. Due to village politics, the petitioner has been made accused in the present case. There is no recovery of any incriminating article from possession of the petitioner. Other coaccused have been granted bail by this Court as well as another Co-ordinate Bench of this Court vide Cr. Misc. No. 11555 of 2019 under order dated 12.04.2019 and Cr. Misc. No. 26490 of 2019 under order dated 12.06.2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd A.D.J. Naugachia, Bhagalpur, in connection with Sessions Trial No.
