JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner and the State. The P.D.S. license of the petitioner was earlier suspended and thereafter cancelled on 19.02.2013. The petitioner submits that the license has been cancelled without issuance of show-cause notice merely on the ground of pendency of a criminal case.

A P.D.S. license cannot be cancelled without issuance of show-cause notice on mere pendency of a criminal case.

In this view of the matter, the impugned order cancelling the P.D.S. license of the petitioner is set aside and the matter is remitted to the licensing authority to proceed afresh in

Patna High Court CWJC No.20774 of 2013 (2) dt.24-09-2015 2 / 2 accordance with law after issuing show-cause notice to the petitioner.

This application stands allowed.
