JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-07-2017 Heard Sri Prashant Kumar, learned counsel for the petitioner, and Sri Sanjay Kumar Singh, learned A.P.P. for the State.

The petitioner in the present case is seeking regular bail in connection with Daraunda (Daronda) P.S. Case No. 296/2015 registered for offences punishable under Section 302 read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has placed the Fardbeyan of the informant in which there is specific allegation against one Janak Singh. The said Janak Singh has been granted regular bail by a co-ordinate bench of this Court vide order dated 14.07.2016 in Cr. Misc. No. 19863/2016. Learned counsel submits that although the petitioner was made accused in one Daraunda

Patna High Court Cr.Misc. No.27930 of 2017 (3) dt.06-07-2017 2/2 P.S. Case No. 122/2016 under Sections 302, 307, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act, however, he has been granted bail in the said case by this Court; save and except the said one case, there is no other case against the petitioner.

Learned A.P.P. opposed the prayer for bail.

However, considering the fact that the main accused against whom there is specific allegation has already been granted bail, let the petitioner, namely, Jitendra Kumar Singh @ Jitendra Singh, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge IV, Siwan in connection with Sessions Trial No. 219/17 arising out of Daraunda (Daronda) P.S. Case No. 296/2015.
