Petitioner seeks regular bail in connection with Dhoraiya P.S. Case No.176 of 2012 registered for the alleged offences under Sections 395 and 412 of the Indian Penal Code. As per the prosecution case, the informant along with other persons were robbed of their cash and mobile phones on the way by seven unknown miscreants.

It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. Petitioner's name came in this case on the basis of the statement made by one co-accused Tipendra Kumar. He has been falsely implicated in this case. The allegations levelled against the petitioner are general and omnibus in nature. He has been

Patna High Court Cr.Misc. No.29506 of 2017 (02) dt.01-07-2017 2/2 languishing in jail custody since 19.04.2017. Though there are criminal cases against the petitioner but he is on bail in all those cases. Similarly situated co-accused persons, namely, Daya Nand Thakur and Tipendra Kumar @ Tippa have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. Nos.9599 of 2013 and 12266 of 2013 both vide order dated 30.08.2013. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhoyaiya P.S. Case No.176 of 2012.
