JUSTICE SUDHIR SINGH ORAL ORDER 28-11-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Bhagwanpur P.S. Case No. 191 of 2016 for the offences instituted under Sections 341, 323, 324, 326 and 504/34 of the IPC.

The prosecution story, in brief, is that the petitioners were taking away electric wire passing over his Asbestos house, which was broken in the storm two-three days earlier, in which the child as well as cow of the informant faced electric current and saved anyhow. Thereafter, petitioner no. 1 called her daughter and son-in-law and ordered to assault her, then Rani Devi thrashed her aunt by pulling hair and Sita Devi and Bablu Sahni assaulted her with fists and slaps. Then the aunt of the informant raised alarm and on halla, the brother of the informant, Md. Sarbar came to save her aunt then all the accused persons assaulted them with intent to kill with sharp cutting weapons and sustained injuries. On halla, the Mohalla people came and intervened. His brother was taken to Sadar Hospital, Begusarai for treatment.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. They have falsely been implicated in the present case. General and omnibus allegation has been made against the petitioners. The nature of injury is said to be simple.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Bhagwanpur P.S. Case

No.50525 of 2016 (2) dt.28-11-2016 3/3 No. 191/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
