This is a case registered under Sections 341, 504,324,302,307/34 of the Indian Penal Code and 27 of the Arms Act.
Counsel for the petitioner submits that his name has been mentioned in the FIR only because he is alleged to be driver of Ex-M.L.A, who along with his family members and other persons have committed crime. There is no specific allegation against the petitioner. He further submits that from perusal of the FIR it would be apparent that there is no allegation that he was holding any arms or assaulted anyone. He has also stated in paragraph 3 of his petition that he has clean antecedent. The petitioner is in custody since 03.04.2017. He also submits that
Patna High Court Cr.Misc. No.28747 of 2017 (2) dt.01-07-2017 2/2 one of the co-accused who is said have instigated other coaccused has already been granted bail by order dated 06.06.2017 passed in Cr. Misc. No. 26539 of 2017.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge-cum-Additional Chief Judicial Magistrate, Bikramganj, Rohtas in Bikramganj P.S. Case No. 84 of 2017.
