ANJANA MISHRA ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.09.2018 in connection with Chenarai P.S. Case No. 149 of 2018, registered for the offence under Section 382 of the Indian Penal Code and subsequently Section 395 of the Indian Penal Code has added.

Learned counsel for the petitioner submits that the petitioner's name has surfaced in the confessional statement made before the police by one Rahul Kumar and there is no recovery from the petitioner. Till date the petitioner has not been put on T.I. Parade and only on the basis of his own confessional statement, the petitioner has been implicated in connection with the present case. Considering the aforementioned facts and circumstances and the period of custody, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Additional Chief Judicial Magistrate-II, Rohtas at Sasaram, in connection with Chenari P.S. Case No. 149 of 2018.
