JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.

Petitioner is brother of the husband of the deceased. There is general and omnibus allegation of demand of dowry and torture for the same, which resulted in dowry death of Babita Devi, the niece of the informant.

Learned counsel for the petitioner submits that the petitioner is separate from his brother and the deceased and has been falsely implicated on suspicion.

Considering the facts and circumstances

Patna High Court Cr.Misc. No.17336 of 2017 (3) dt.03-07-2017 2/2 aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura/Successor Court, in connection with Madhepura (Ghailardh) P.S. Case No.585 of 2014, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
