2. The petitioner has preferred this application for grant of regular bail in connection with S.T. No. 175 of 2025 arising out of Phulwariya P.S. Case No. 104 of 2024 dated 20.07.2024 registered for the offences punishable u/ss 103, 80(2), 61(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, after two months of marriage, the petitioner and the co-accused persons started torturing the informant's sister and they used to abuse and assault the informant's sister and earlier, they had also tried to kill her. On 19.07.2024, the petitioner informed the informant

The informant apprehended that the petitioner had illicit relationship with one Archana Gupta (sisterin-law of the petitioner) due to which the accused persons have committed murder of his sister under conspiracy.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the husband of the deceased and he has no concern with the alleged offence. The petitioner has neither demanded any dowry nor tortured the deceased. Learned counsel has further submitted in para 24 of the bail petition that the co-accused, Shambu Prasad Gupta and Milan Devi have been allowed the privilege of bail by this Hon'ble Court in Cr. Misc. No. 7879/2025 vide order dated 12.05.2025. The petitioner has one criminal antecedent in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 21.07.2024.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner and submitted that the petitioner is the husband of the deceased.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.60245 of 2025(2) dt.10-09-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with S.T. No. 175 of 2025 arising out of Phulwariya P.S. Case No. 104 of 2024.

7. The application stands allowed.
