Let the defect(s), as pointed out by the office, be removed within a period of four weeks from today. Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks bail in connection with Punaura P.S. Case No. 50 of 2021 registered for the offences punishable under Sections 364(a), 302, 201, 120(b) of the Indian Penal Code.
As per the prosecution case, the son of the informant
Patna High Court CR. MISC. No.71937 of 2021(3) dt.11-08-2022 2/3 was kidnapped and demand of Rs. 10 lacs was made by way of ransom.
It is submitted by learned counsel for the petitioner that the FIR was registered against accused persons using the mobile numbers from which the demand of ransom was made. It is submitted that the petitioner was not named in the FIR and his name transpired in the confessional statement of co-accused. No incriminating article has been recovered from the petitioner's possession who is in custody since 23.03.2021. Petitioner bears no criminal antecedent. Chargesheet has been submitted in the case.
The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and on perusal of the material on record it transpires that in course of investigation the accused persons were arrested and the confessional statement of the five named accused persons including the petitioner herein was recorded which led to recovery of the dead body of the son of the informant. In the facts of the case, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. The learned trial court is directed to conclude the trial,
