JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-05-2024 This is the second anticipatory bail application filed on behalf of the petitioners, earlier the anticipatory bail petition of the petitioners was rejected by this Court vide order dated 17.07.2023 .
2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 406, 420, 467, 471 , 468 and 120(B) and other allied sections of the Indian Penal Code .
3 . As per the prosecution case , this petitioner
Patna High Court CR. MISC. No.76234 of 2023(5) dt.03-05-2024 2/2 along with other co-accused persons caused loss of Rs. 2 crore 78 lakh by cheating and creating forged and fabricated documents.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Petitioners are neither connected with the company in question nor they have any concern with the alleged occurrence. They are monthly paid employee of Service Center of H. Y motors, which deals Bajaj 3 wheelers Auto rickshaw. Petitioners claim clean antecedent.

Learned counsel for the State oppose the bail petition and submits that there is direct and specific allegation against these petitioners that they along with other co-accused persons cheated the complainant and caused loss of Rs. 2 crore 78 lakh to the company in question by creating forged and fabricated documents.
6. Considering the facts that these petitioners caused loss of huge amount and other circumstances of the case, the anticipatory bail application of the petitioners is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
