The petitioner seeks bail in Nanpur P.S. Case No. 08 of 2017 registered under Section 414/34 of the Indian Penal Code and 25(1-B)a, 26 of the Arms Act.

As per prosecution case, looted stolen motorcycle was recovered from the possession of the petitioner and two his companion and a mobile phone was also recovered from the possession of the petitioner in course of vehicle checking. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing incriminating has been recovered from the conscious possession of the petitioner. He was not driving the

Patna High Court Cr.Misc. No.28806 of 2017 (2) dt.03-07-2017 2/2 motorcycle rather he was pillion rider . The petitioner has been languishing in custody since 09.01.2017.

Considering the facts aforesaid, the above named petitioner is directed to enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Nanpur Town P.S. Case No. 08 of 2017.
