JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. The petitioners pray for bail in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, on 10.07.2021 at about 12.00 hrs., when the informant alongwith other police personnel raided village Bakkachak, this petitioner alongwith other villagers attacked the police party in which several police personnel got injured. It is further alleged that the accused also tried to snatch the rifles from the police team. It is submitted on behalf of petitioner that there is general and omnibus allegation against this petitioners and specific allegation of overt act is against other co-accused persons. Most of the injuries have been found to be simple in
Patna High Court CR. MISC. No.71474 of 2021(3) dt.26-04-2022 2/2 nature by the doctor. Petitioner claims clean antecedent and is in custody since 11.07.2021.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Nalanda at Biharsharif in connection with Sare P.S. Case No. 85 of 2021.
