Petitioner wants modification in order dated 12.03.2015 passed in Cr. Misc. No. 9933 of 2015 by which he was granted privilege of anticipatory bail with condition that he shall surrender before the court below within four weeks from the date of receipt of the aforesaid order.

Submission on behalf of the petitioner is that before passing above stated order dated 12.03.2015 in Cr. Misc. No. 9933 of 2015, petitioner went abroad and returned on 20.10.2016 and after that he came to know about above stated order and, therefore, he wants extension of time for surrender before the court below in connection with Hussainganj (M.H. Nagar) P.S. Case No. 173 of 2014.

Patna High Court Cr.Misc. No.50942 of 2016 (3) dt.15-02-2017 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this modification petition is allowed with direction to petitioner to surrender before the court of Chief Judicial Magistrate, Siwan/concerned court in connection with above stated case within two weeks from the date of receipt/production of copy of this order and if petitioner does so, the concerned court shall proceed in the light of order dated 12.03.2015 passed in Cr. Misc. No. 9933 of 2015. Accordingly, order dated 12.03.2015 passed in Cr. Misc. No. 9933 of 2015 stands modified to the above sated extent. In the aforesaid manner, this modification petition stands disposed of.
