The petitioner seeks bail in a case instituted under Sections 8/20(b)(ii)(B) of N.D.P.S. Act and 3(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that 5.900 kg of Ganja along with 180 ml. of foreign liquor is said to have been recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.02.2017. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 4.900 Kg

Patna High Court Cr.Misc. No.30576 of 2017 (2) dt.07-07-2017 2/2 of Ganja and 180 milliliters of country made wine is said to have been recovered from the possession of the petitioner. The alleged Ganja is less than the commercial quantity. There is no compliance of section 100 of the Cr.P.C.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger, in connection with Kotwali (Basudeopur) P.S. Case No. 54 of 2017.
