JUSTICE ARUN KUMAR ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Naubatpur P.S. Case No.231 of 2016 registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation is that due to land dispute, accused persons including the petitioner came into the house of the informant after midnight and shot at his father. Learned counsel for the petitioner submits that admittedly there is a land dispute and on account of that this false case has been lodged. Moreover, there is no probability to enter inside the house after midnight when the doors are locked, the

Learned counsel for the informant submits that the deceased was sleeping in the Verandah outside of the house and the wife of the deceased saw this petitioner running away after killing the deceased and other witnesses are also witness to this fact.
Having considered the nature of allegation, prayer for anticipatory bail on behalf of the petitioner is rejected in connection with Naubatpur P.S. Case No.231 of 2016, pending in the court of the learned Additional Chief Judicial Magistrate-II, Danapur.
However, if the petitioner surrenders and seeks regular bail, the same shall be considered on merit. (Arun Kumar, J.) S.Kumar/- U T
